Responsibilities and Authorities Lawsuit Affairs (Civil – Criminal)
a) Civil lawsuits: preparing and collecting the required documentation in order to draw up legal petitions or statements of defense; presenting petitions to the judicial authority, filing them and getting docket and tracking numbers; attending hearings after dates are set; following up and learning about the content of pronounced judgments for and against the University and following up the enforcement of judgments; as well as objecting to and appealing judgments pronounced against the University
b) Claiming damages from those who breach contracts and those who refuse to fulfill their obligations through judicial authorities, notary public offices or the Organization for Registration of Deeds and Properties
c) Legal action regarding eviction and claiming damages as well as unpaid rent
d) Commitment to the fulfillment of obligations through different legal methods such as approaching judicial authorities, notary public offices and the Organization for Registration of Deeds and Properties
e) Assessing and responding to legal claims proposed against the University through non-judicial authorities
f) Assessing, attending the meetings of the Court of Administrative Justice and responding to complaints filed by natural and legal persons against the University as well as related institutes
g) Criminal lawsuits: preparing and collecting the required documentation in order to file complaints
h) Presenting complaints to the judicial authority (referral judge), filing them and getting docket numbers
i) Approaching the referred unit, completing the statements form and filing the documents
j) Following up through judicial authorities and police (examining magistrate, assistant public prosecutor, police station and the Criminal Investigation Department)
k) Introducing a legal representative, attendance at the appointed time and following up until results are achieved
l) Appealing judgments pronounced against the University
m) Following up the enforcement of final and definitive judgments
n) Providing legal support for staff and officials before judicial authorities
Contract Affairs
a) Preparing and drawing up: papers stating the conditions for tenders and auctions, papers stating the conditions for inquiries, attachments of auctions, contracts required by the University’s affiliated units as well as supplements and revisions of contracts based on issued licenses
b) Assessment and expressing expert opinions regarding contracts sent by the University’s affiliated units, preparing and designing the required forms as well as assessing the required documentation in order to draw up contracts
c) Preparing and drawing up the required package and service checklist as well as taking corrective measures
d) Putting the information regarding the auctions and tenders of the University on the website of the University, the National Database Portal of Iran Tenders and the website of the General Inspection Organization of Iran
e) Writing newspaper advertisements regarding the tenders and auctions of the University
f) Coordinating and planning meetings about the opening of offers for the tenders and auctions of the University and writing meeting minutes of the commission
g) Studying and following the instructions, directives as well as financial and transactional bylaws of the University about writing terms and conditions as well as contracts
Obligation Affairs
a) Assessing obligation status and receiving academic indemnity from obligors who ignore fulfilling their legal obligations
b) Taking the necessary measures while corresponding about the obligation document and determining the amount of debt obligors owe to the University through organizations and related sections which pay salaries or through officials whose names have been inserted into the obligation document
c) Obtaining formal obligation from individuals with regard to passing academic courses and sabbaticals as well as obtaining proprietary and non-proprietary pledge from applicants who wish to be granted scholarships
d) Following up the documents of individuals who are obliged to serve and those who refuse to serve, annulling documents whose obligations have expired as well as supervising and taking action to issue writs of execution regarding enforceable documents
e) Taking action to redeem a pledge in the event that obligations are fulfilled by the obligor through the related notary public office and the Execution of Documents Department until results are achieved
f) Requesting the issuance of writs of execution in the event that obligations are not fulfilled and sending them to the Execution of Documents Department in order to collect debts
g) Corresponding with the organization of the civil servant, who is the guarantor on a loan, regarding the amount of debt and their payroll deduction
Property Affairs
a) Collecting the documentation pertaining to the ownership of University properties and sending the original and formal ownership certificates to the province’s State Properties Organization or to the specific treasury of the Department of Finance
b) Approaching the Organization for Registration of Deeds and Properties, the State Properties Organization, the Islamic Revolution Housing Foundation, the Roads and Urban Development Department etc. in order to follow up the issuance of certificates for those University properties which lack ownership certificates
c) Drawing up agreements, leases etc. regarding transferring University properties to natural or legal persons
d) Drawing up agreements, protocols etc. regarding properties which are transferred to the University by natural or legal persons
e) Responding to the inquiries of affiliated units regarding University properties
Carrying Out Other Assigned Tasks
a) Responding to inquiries made by judicial and legal authorities, other public institutions like the municipality as well as the University’s affiliated units
b) Responding to complaints filed by the Labor and Social Affairs Organization and attending the meetings of Discernment Branches, objecting to judgments pronounced by Discernment Branches and filling the objection, attending the meetings of Dispute Resolution Branches and responding to the protests of supervisory authorities
c) Responding to the claims of the Social Security Organization, filing objections to the announced figures, attending the meetings of the Primary Board of Demands Discernment, objecting to judgments pronounced by the Primary Board of Demands Discernment and filing the objection as well as attending the meetings of the Revision Board of Demands Discernment
d) Carrying out other tasks assigned by University officials and the superior authority
